FLORIDA SUNSHINE LAWN CARE MOBILE TERMS OF SERVICE

Agreement to Receive Text Messages
By providing your mobile telephone number and affirmatively opting into any Florida Sunshine Lawn Care (“Florida Sunshine Lawn Care,” “Company,” “we,” “our,” or “us”) text messaging program, you expressly consent to receive recurring automated and non-automated text messages from us at the mobile number you provided. Messages may be sent using an automatic telephone dialing system, manual dialing, artificial voice technology where permitted by law, or other lawful messaging technologies. Your consent applies only to the mobile number you provide and is not a condition of purchasing any goods or services.
Types of Messages You May Receive
Depending on your relationship with Florida Sunshine Lawn Care, you may receive text messages regarding estimate requests, appointment confirmations, appointment reminders, scheduling updates, technician arrival notifications, weather-related service delays, service completion notices, billing reminders, payment confirmations, customer support responses, account updates, recurring lawn maintenance reminders, seasonal landscaping recommendations, promotional offers, discounts, special events, customer satisfaction surveys, and other service-related communications.
Message Frequency
The number of messages you receive will vary depending on your interaction with Florida Sunshine Lawn Care, the services you request, your account activity, and your communication preferences. Some customers may receive only occasional transactional messages, while others enrolled in recurring maintenance or promotional programs may receive additional messages.
Message and Data Rates
Message and data rates may apply according to your wireless carrier’s pricing plan. Florida Sunshine Lawn Care does not charge a separate fee to participate in its text messaging program; however, your wireless carrier may impose charges for sending or receiving messages. Please consult your wireless service provider regarding your mobile plan.
How to Opt In
You may opt into our mobile messaging program by providing your prior express consent through one or more approved methods, including submitting a website form, requesting an estimate, scheduling an appointment, completing an online service request, signing a paper or electronic agreement, scanning a QR code, initiating a text message to our business, providing verbal consent where legally permitted, or using another approved consent method. Where required by law or wireless carrier requirements, Florida Sunshine Lawn Care may require additional verification, including a double opt-in confirmation, before marketing text messages are delivered.
How to Opt Out
You may opt out of receiving marketing text messages at any time by replying STOP to any message you receive from Florida Sunshine Lawn Care. After we receive your request, we will send a single confirmation message confirming your opt-out, after which no additional marketing text messages will be sent unless you provide new consent. Opting out of marketing messages does not prevent us from sending legally permitted transactional or service-related communications necessary to fulfill services you have requested.

Consent Records
Florida Sunshine Lawn Care maintains records of customer consent to demonstrate compliance with the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles and Best Practices, LeadBranch requirements, wireless carrier requirements, Toll-Free Verification requirements, Short Code requirements, and other applicable federal and state laws. Consent records may include your mobile telephone number, the date and time consent was obtained, IP address, website URL, landing page, consent language presented, browser and device information, user agent, session identifiers, source of consent, confirmation records, opt-in verification records, SMS interaction history, and any additional information reasonably necessary to verify lawful consent. These records may be retained for the period required by applicable law or carrier requirements.
Privacy of Mobile Information
Your privacy is important to us. Your mobile telephone number, SMS consent, and opt-in information are treated as confidential. SMS consent is not shared with third parties or affiliates for their own marketing purposes. We do not sell, rent, lease, or otherwise disclose your mobile information for independent marketing.
We may share your information only with trusted service providers who assist us with text messaging platforms, telecommunications services, cloud hosting, customer relationship management, appointment scheduling, payment processing, fraud prevention, customer support, legal compliance, and other operational services necessary to provide our business services. These providers are contractually obligated to protect your information and may use it only for authorized business purposes.
Wireless Carrier Disclaimer
Wireless carriers are not liable for delayed, undelivered, or misdirected messages. Message delivery is subject to your wireless carrier’s network availability and other factors beyond the control of Florida Sunshine Lawn Care.
Supported Carriers
Our messaging program is intended to operate on most major United States wireless carriers. However, message availability and delivery may vary depending on your wireless provider, device compatibility, network conditions, and geographic location.
Eligibility
You represent that you are the authorized subscriber or customary user of the mobile telephone number you provide and that you are at least eighteen (18) years of age or otherwise legally authorized to consent to receive text messages under applicable law.
Changes to the Messaging Program
Florida Sunshine Lawn Care reserves the right to modify, suspend, or discontinue its mobile messaging program, message frequency, supported programs, short codes, toll-free numbers, or these Mobile Messaging Terms at any time. Any revised terms become effective upon posting. Your continued participation in the messaging program after changes are posted constitutes acceptance of the revised terms.
Disclaimer of Warranties
The mobile messaging program is provided on an “AS IS” and “AS AVAILABLE” basis. Florida Sunshine Lawn Care makes no warranty that messages will be delivered without interruption, delay, or error, and disclaims all warranties to the fullest extent permitted by applicable law.
Limitation of Liability
To the fullest extent permitted by law, Florida Sunshine Lawn Care shall not be liable for any delayed, failed, or misdirected text messages, network interruptions, carrier outages, device incompatibility, or any indirect, incidental, consequential, special, exemplary, or punitive damages arising from participation in the mobile messaging program.
Governing Law
These Mobile Messaging Terms shall be governed by and construed in accordance with the laws of the State of Florida without regard to its conflict of law principles. Any dispute arising from these Terms shall be resolved in the appropriate state or federal courts located within the State of Florida unless otherwise required by applicable law.
