These Mobile Messaging Terms and Conditions (“Mobile Terms”) govern your participation in the mobile messaging programs offered by Florida Sunshine Lawn Care (“Florida Sunshine Lawn Care,” “Company,” “we,” “our,” or “us”). By opting in to receive SMS or MMS text messages from us, you agree to these Mobile Terms, our Privacy Policy, and any applicable Terms of Service. 

PROGRAM DESCRIPTION 

Florida Sunshine Lawn Care may send recurring conversational, informational, transactional, and promotional text messages related to lawn care services, landscaping services, estimates, scheduling, appointment confirmations, service updates, billing notices, account notifications, customer support communications, seasonal offers, discounts, promotions, and other business-related communications. 

Message frequency may vary depending on your interactions with us, account activity, requested services, and ongoing promotions. 

CONSENT TO RECEIVE TEXT MESSAGES 

By providing your mobile phone number and opting into our messaging program, you expressly consent to receive recurring automated marketing and non-marketing text messages from Florida Sunshine Lawn Care at the phone number provided. 

Consent is not a condition of purchase. Your agreement to receive text messages is completely voluntary. 

You represent that you are the authorized user of the mobile number provided and that you are authorized to consent to receive messages at that number.

SUPPORTED CARRIERS 

Supported carriers may include AT&T, Verizon Wireless, T-Mobile, Sprint, U.S. Cellular, and other participating wireless carriers. Carriers are not liable for delayed, undelivered, or failed messages. 

Wireless carriers are not responsible for delayed or undelivered messages. 

SHORT CODE, 10DLC, AND TFN COMPLIANCE 

Florida Sunshine Lawn Care complies with applicable industry standards and guidelines relating to SMS messaging programs, including requirements established by wireless carriers, The Campaign Registry, CTIA, and applicable federal and state laws, including the Telephone Consumer Protection Act (“TCPA”) and Florida telemarketing laws. 

We maintain records of consumer consent where required by law. 

We do not sell, rent, or share SMS opt-in data or consent with third parties for their own marketing purposes. 

Text messaging originator opt-in data and consent will not be shared with any third parties, excluding aggregators and providers of the text messaging services necessary to deliver the SMS service. 

USER RESPONSIBILITIES 

You agree to provide accurate and complete information when enrolling in our messaging programs. You are responsible for notifying us if your mobile number changes. 

You agree not to use our messaging services for unlawful, abusive, or fraudulent purposes.

WARRANTY DISCLAIMER

Messaging services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. 

LIMITATION OF LIABILITY 

To the maximum extent permitted by Florida law, Florida Sunshine Lawn Care shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to your participation in any messaging program. 

Our total liability for any claim relating to the messaging program shall not exceed one hundred dollars ($100). 

FLORIDA GOVERNING LAW 

These Mobile Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. 

Any disputes arising out of or relating to these Mobile Terms shall be resolved exclusively in the state or federal courts located in Florida, unless otherwise required by applicable law. 

 

ARBITRATION AND CLASS ACTION WAIVER 

To the fullest extent permitted by law, any dispute arising from these Mobile Terms or the messaging program shall be resolved through binding individual arbitration and not in court, except for matters eligible for small claims court. 

You waive any right to participate in class actions, class arbitrations, private attorney general actions, or representative proceedings. 

If any portion of this arbitration provision is found unenforceable, the remaining portions shall remain in full force and effect. 

CHANGES TO THESE MOBILE TERMS 

Florida Sunshine Lawn Care reserves the right to modify or update these Mobile Terms at any time. Changes will become effective immediately upon posting to our website. 

Your continued participation in our messaging programs following any changes constitutes your acceptance of the revised Mobile Terms.
