These Terms of Service (“Terms”) govern your access to and use of our website, online forms, estimate requests, scheduling platform, customer portal, mobile messaging programs, communications, and all lawn care, landscaping, and related services offered by the Company. By accessing our Website, requesting an estimate, scheduling services, submitting your information, enrolling in recurring maintenance, subscribing to communications, or otherwise using our services, you agree to be legally bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you should discontinue use of the Website and refrain from using our services.
Changes to These Terms
Florida Sunshine Lawn Care may revise these Terms from time to time to reflect changes in our services, legal obligations, wireless carrier requirements, or business practices. Unless otherwise stated, revised Terms become effective immediately upon posting to the Website. Your continued use of the Website or our services after any modifications constitutes your acceptance of the updated Terms.
Eligibility
You must be at least eighteen (18) years of age and legally capable of entering into a binding agreement to use our Website or request services. Florida Sunshine Lawn Care provides residential and commercial lawn care, landscaping, mowing, edging, trimming, seasonal maintenance, outdoor maintenance, and related property services throughout Florida. Service availability depends on numerous factors, including geographic service areas, weather conditions, staffing, equipment availability, property accessibility, scheduling capacity, and operational considerations. We reserve the right to refuse, suspend, delay, or discontinue services for any lawful reason.
Estimates, Quotes, and Scheduling
Any estimate, quote, pricing information, completion timeline, or projected schedule provided by Florida Sunshine Lawn Care is offered for informational purposes only and does not constitute a binding guarantee. Final pricing may vary based upon property size, accessibility, labor requirements, materials, weather conditions, safety concerns, additional work requested, or conditions discovered after an on-site inspection. Submission of an estimate request does not obligate either party to enter into a service agreement.
Recurring Maintenance Services
Certain lawn care and landscaping services may be offered through recurring service plans, including weekly, bi-weekly, monthly, seasonal, or annual maintenance programs. Recurring services will continue until canceled by either party in accordance with the applicable service agreement. We reserve the right to modify pricing, service routes, scheduling, or maintenance frequency upon reasonable notice.
Payments
Unless otherwise agreed in writing, payment is due upon completion of services. For recurring maintenance or larger projects, Florida Sunshine Lawn Care may require deposits, advance payments, a valid payment method on file, or authorization for automatic billing. Any unpaid balance may accrue interest at the maximum rate permitted under Florida law. You agree to pay all reasonable costs of collection, including attorneys’ fees, arbitration costs, court costs, and collection agency expenses. Returned payments, failed electronic payments, declined payment methods, or chargebacks may result in suspension or termination of services.
Communications Consent
By voluntarily providing your telephone number, mobile number, email address, or other contact information through our Website, advertisements, estimate forms, landing pages, customer portal, scheduling system, social media, telephone conversations, or any other communication channel, you expressly authorize Florida Sunshine Lawn Care to communicate with you regarding your inquiries, estimates, appointments, customer support, existing services, account information, and marketing offers where permitted by law. Communications may be delivered by telephone calls, SMS or MMS text messages, email, prerecorded voice, artificial voice technology, automated telephone dialing systems, manual dialing, or other legally permissible technologies. Your consent is provided in accordance with the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles and Best Practices, applicable wireless carrier requirements, and all applicable federal and Florida laws. Providing consent to receive marketing communications is not a condition of purchasing any goods or services.
Mobile Messaging Program
Florida Sunshine Lawn Care offers one or more SMS and MMS messaging programs to improve communication with customers. Depending upon your relationship with us, text messages may include estimate notifications, appointment confirmations, appointment reminders, scheduling updates, technician arrival notifications, weather delay notices, service completion confirmations, billing reminders, payment confirmations, account updates, customer support responses, seasonal lawn care reminders, maintenance recommendations, promotional offers, discounts, customer surveys, satisfaction requests, and other service-related communications. Message frequency will vary depending on your interactions with the Company. Standard message and data rates may apply according to your wireless carrier’s plan. Wireless carriers are not responsible for delayed or undelivered messages.
SMS Opt-In Requirements
You will receive marketing text messages only after providing your prior express consent through an approved opt-in method. Acceptable methods include Website forms, estimate request forms, appointment scheduling, online service requests, paper forms, electronic agreements, QR codes, customer-initiated text messages, verbal consent where legally permitted, or other approved consent mechanisms. When required by applicable law or wireless carrier requirements, Florida Sunshine Lawn Care may utilize additional verification procedures, including double opt-in confirmation, before marketing messages are sent.
Opt-Out Instructions
You may opt out of receiving marketing text messages at any time by replying STOP to any message. After opting out, you will receive one confirmation message confirming your request, and no further marketing messages will be sent unless you opt in again. For assistance, reply HELP to any text message or contact our customer support directly. Opting out of marketing communications does not prevent us from sending legally permitted transactional or service-related messages necessary to provide services you have requested.
Consent Records
To demonstrate compliance with the TCPA, CTIA Messaging Principles and Best Practices, LeadBranch requirements, wireless carrier policies, Short Code requirements, Toll-Free Verification requirements, and other applicable laws, Florida Sunshine Lawn Care maintains records documenting customer consent. These records may include your mobile telephone number, date and time of consent, IP address, Website URL, landing page, consent language presented, browser information, device information, user agent, session identifiers, source of consent, confirmation records, SMS interaction history, opt-in verification records, and any additional information reasonably necessary to verify lawful consent. Protection of Mobile Information
Your mobile telephone number, SMS consent, and opt-in information are treated as confidential. Disclaimer of Warranties
The Website and all services are provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, Florida Sunshine Lawn Care disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, availability, accuracy, non-infringement, and uninterrupted service. Because lawn care results are influenced by weather, irrigation, soil conditions, pests, disease, customer maintenance practices, and other environmental factors beyond our control, we do not guarantee any particular landscaping or lawn care outcome.
Limitation of Liability
To the fullest extent permitted by applicable law, Florida Sunshine Lawn Care shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of the Website, communications, or services. Our total cumulative liability for any claim shall not exceed the greater of the amount paid for the specific service giving rise to the claim or One Hundred Dollars ($100.00).
Indemnification
You agree to defend, indemnify, and hold harmless Florida Sunshine Lawn Care, its owners, employees, contractors, affiliates, agents, successors, and assigns from and against any claims, liabilities, damages, losses, costs, expenses, or reasonable attorneys’ fees arising out of or related to your violation of these Terms, misuse of the Website or services, violation of applicable law, inaccurate information you provide, or your negligent or intentional conduct.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the appropriate state or federal courts located within the State of Florida unless otherwise required by applicable law.
Severability
If any provision of these Terms is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect and shall be interpreted to give the greatest lawful effect to the parties’ original intent.
Entire Agreement
These Terms, together with our Privacy Policy and any applicable service agreements, estimates, invoices, work orders, or other written contracts between you and Florida Sunshine Lawn Care, constitute the entire agreement regarding your use of our Website, communications, mobile messaging program, and services and supersede all prior or contemporaneous discussions, representations, negotiations, or agreements relating to the same subject matter.
